What happens at my first Court appearance?

If you’ve been charged with a criminal offence in NSW, your first court appearance is often the most stressful part of the process. Knowing what to expect can take away some of the uncertainty and help you feel more prepared.
Where will my case be heard?
Most criminal matters in NSW start in the Local Court. Your charge sheet or bail papers will state the date, time, and location of your first appearance. It’s important that you arrive on time, dressed neatly, and ready to be called before the magistrate.

What actually happens on the day?
At your first appearance:
- Your matter will be called before the magistrate.
- The court will confirm the charge against you.
- You’ll be asked whether you intend to plead guilty or not guilty.
- If you haven’t yet obtained legal advice, you can usually request an adjournment to give you more time.
Do I have to say much?
You don’t need to explain your case in detail at this stage. The purpose of the first appearance is largely procedural. Your lawyer can speak for you and make sure nothing is said that might harm your defence.
